           Child support and spousal support [sometimes called
maintenance or alimony] are often a part of divorce [or legal
separation] proceedings.  Child support issues arise in other
situations as well, such as in paternity cases or custody cases
(when the parties were not married).

      In Colorado, there is a formula for use in determining
the amount of child support.  It is based upon the incomes of
the parents and various other factors such as the parenting
time (visitation) schedule, child care expenses, health
insurance expenses and so on.  In the majority of situations,
the Court requires that this formula be adhered to.  Some
exceptional circumstances can justify a deviation from the
formula.

      Spousal support is usually determined by negotiation
between the parties (or their attorneys) rather than by a
formula like the child support formula.  Many factors are
considered in assessing whether or not spousal support is
appropriate, and if so how much and for how long.   These
factors include the length of the marriage, the ages and
health of the parties, the relative financial circumstances,
including income, of the parties, their needs, standard of
living and so on.  

      Support, be it child support or spousal support, can be
enforced and collected, once it is ordered by the court.  It
can either be paid directly by one party to the other, or it
can be made payable through the Family Support Registry, a
clearing house and record keeping service of the state
government.  Support can also be withheld from the paycheck
of the "obligor" or paying party.
