There are two classifications of Stepparent Adoption: The first involves those situations where the non-custodial natural parent is willing to sign a written CONSENT to the adoption, thereby relinquishing his or her parental responsibilities to the child; and second, those cases where the non-custodial parent has abandoned the child, refuses to sign a consent, or simply cannot be located after reasonable effort. A parent has "abandoned" a child, thereby making the child available for adoption by a stepparent, when the non-custodial natural parent has had no contact with the child for a year or more; or fails without cause to provide reasonable support for the child for a year or more. If either or both of these apply, the adoption may go through even if the non-custodial parent opposes it. The adopting stepparent and the custodial natural parent must have been married for at least one year before such an adoption can be processed.
