Custody cases (know referred to as "Parental
Responsibility Cases") can arise either in the context of a
divorce or when a couple, who are not married, have a
child together. Both are handled similarly. More often
than not one or both parents seek court orders defining
one another's responsibilities with respect to the child and
each other so as to instil some predictability and order
when it comes to parenting time, child support and
decision-making.
Just as with divorces, custody cases can be either
contested or uncontested. Some contested cases involve
high conflict and require the involvement of
court-appointed experts to investigate what is best for the
child and make recommendations to the Court. Custody
issues can sometimes be the most polarizing and difficult to
deal with for the Courts and the parties, because of the
emotions which are often involved.
