A case is generally considered to be "contested"
whenever there are one or more issues or matters as to
which the parties are unable to come to an agreement
among themselves. When parties cannot agree on how
they want to resolve an issue then it becomes necessary
for the case to go before a judge in what is known as a
"trial" or "hearing" so that the judge can resolve the
issue(s) for the parties.
Some of the more common things that are sometimes
"contested" include:
Custody of children
Parenting time
Child support
Spousal support
Property and debt division
Because the amount of time and effort involved in a
contested case is highly variable and unpredictable, most
lawyers, including Mr. Calder, charge by the hour instead
of on a Flat Fee basis. How much your case ultimately ends
up costing thus depends on how much time is spent handling
it.
